- Definitions
The "hirer" shall mean the person, company, firm or other body taking
the costumes on hire and includes their successors and/or personal representatives.
The "costumes" are the garments wigs masks bags accessories properties
and other articles which 1st Night agrees to hire to the hirer.
The "hire period" is the period from the time the hirer takes
possession of the costumes until the costumes are returned to 1st Night.
- Ownership of costumes
The costumes remain the property of 1st Night. The hirer purchases only the
limited right to use the costumes for the agreed hire period.
- Payment of Hire Charges
Payment of the full cost of hiring the costumes is payable to 1st Night by the
hirer at the commencement of the hire period.
- Security Deposits
A security deposit is also payable by the hirer to 1st Night at the commencement of the
hire period. This deposit shall be refunded to the hirer promptly upon return of
the costumes in good condition. The deposit shall not form part of the assets of
1st Night unless and until it is forfeited by the hirer failing to return the
costumes in good condition on or before the date agreed.
- Advance booking
Costumes may be booked up to six months in advance by leaving the security
deposit at the time of booking. Booking means that 1st Night will not
offer the booked costume to anyone else on the agreed dates. 1st Night
will take all reasonable care to have the costume available on the agreed
dates but will not be responsible for any losses or consequential losses if
the costume is not available on the agreed dates.
- Cancellations
The hirer may cancel a booking at any time up to and including the working
day before the agreed collection date without penalty. 1st Night reserve
the right to charge for cancellations on the agreed collection date itself.
- Returning costumes
The hirer is responsible for the costs of returning the costumes to 1st Night on
or before the date agreed.
- Stained costumes
The hirer must take all reasonable steps to protect the costumes from loss or
harm while during the hire period.
Costumes are hired out in clean condition. If the costumes are found in the
opinion of 1st Night to be unreasonably soiled on return 1st Night reserve the
right to charge the hirer for all cleaning costs up to and including the
replacement price of the costumes plus the reasonable cost of lost hires while
the costume is unavailable.
- Lost or Damaged Costumes
The hirer will pay 1st Night the replacement costs plus the reasonable cost of
lost hires while the costume is unavailable of all hired costumes lost
during the hire period through whatever cause.
Costumes are hired out undamaged. If the costumes are found to be damaged on
return 1st Night reserve the right to charge the hirer for all repair costs up
to and including the replacement price of the costumes plus the reasonable cost
of lost hires while the costume is unavailable.
- Late Return
1st Night reserves the right to charge additional hire for costumes not returned
by the date agreed at a pro rata rate.
- Alterations to costumes
The hirer may not alter or modify the costumes without the knowledge and consent
of 1st Night who may at their discretion refuse such consent or require
additional payment.
- Re-hiring etc.
The costumes shall not be re-hired, sub-let or loaned to any third party without
the knowledge and consent of 1st Night who may at their discretion refuse such
consent or require additional payment.
- Privacy Policy
We are committed to protecting
your privacy. We will only use the information
that we collect about you lawfully in accordance
with the Data Protection Act 1998.
We collect information about you
for three reasons: firstly, to process your hire, to establish
your identity and third, to provide you with the best possible
service.
We will not contact you other than
to complete the hire and return of your costume order unless you have given us
your explicit consent to contact you for other reasons.
We will give you the chance to
refuse any marketing contactsl from us or from
another trader in the future.
The type of information we will
collect about you includes:
your name
address
telephone phone numbers
e-mail addresses
credit/debit card details.
We will never collect sensitive information about you without your explicit
consent.
The information we hold will be
accurate and up to date. You can check the
information that we hold about you by e-mailing
us. If you find any inaccuracies we will delete
or correct it promptly.
The personal information which we
hold will be held securely in accordance with our
internal security policy and the law.
If we intend to transfer your
information outside the EEA (European Economic
Area) we will always obtain your consent first.
This website uses Google Analytics, a web
analytics service provided by Google, Inc. (Google). Google
Analytics uses cookies, which are text files placed on your
computer, to help the website analyze how users use the site. The
information generated by the cookie about your use of the website
(including your IP address) will be transmitted to and stored by

- Consequential losses
Although all reasonable care is taken to provide the hirer with costumes of
merchantable quality and to protect the wearer from harm 1st Night shall be in
no circumstances liable for loss or injury or damage to property resulting from
the using or wearing of costumes howsoever caused.
- Conditions of business
All hire agreements with 1st Night shall be subject to these conditions of
business and no other. No variation of the terms shall be valid unless agreed in
writing and signed on behalf of the hirer and 1st Night.
- Variations and waivers
1st Night may at their discretion waive or vary any of these conditions. Such
variations and waivers will only have force if noted in writing and signed on
behalf of 1st Night.
- Assignment of rights and liabilities
All agreements made between 1st Night and the hirer are individual to the hirer
who shall not assign those rights or liabilities under any agreement subject to
these conditions
